This document, and any others mentioned herein, establishes the terms & conditions governing the purchase of articles on the website www.minusse.com (hereinafter, the website).

Please carefully read these Conditions, as well as our Cookies and Privacy Policy, before using this website. Remember that by using this website or making an order on it you agree to and are bound by these Terms & Conditions, meaning that if you do not agree to them, you must not use the services provided on this website or make purchases from it.

As the owners of this website, we reserve the right to make changes to these Terms & Conditions at any time; the same applies to the commercial conditions of the website (changes in products, prices, promotions and other commercial and service conditions).

As a result, you must remember that the Terms & Conditions in effect at the moment of placing your order will apply and, failing these, those referring to use of the website. We therefore recommend that you consult these Terms & Conditions before purchasing any of our products.

The information or personal data you provide to us or which are collected while you browse the website, will be processed as established in our Privacy Policy.  On using this website, registering as a user or placing an order, you give your consent for the processing of said information and data and state that all of the information and data you provide are correct and reflect your true situation.

  1. WEBSITE OWNER.

All communications with MINUSSE can be sent either to the company address, or to the email info@minusse.com. For queries related to orders and exchanges or returns, please write to pedidos@minusse.com.

  1. USE OF THIS WEBSITE

On using this website and placing orders through it, you undertake to:

  • Use this website for the sole purposes of making legally valid queries or orders.
  • Provide MINUSSE with your email address, postal address and/or other true and exact contact details. You also consent to MINUSSE using said information to contact you when required. In the event of failing to provide these data, we will be unable to process your order or give you the information you request.
  • On placing an order through this website, you state that you are older than 18 years of age and that you have the legal capacity to enter into contracts and obligations.
  1. PLACING AN ORDER. PURCHASING SYSTEM.

Language. The contract can be made out in any of the languages in which the Terms & Conditions are available on this website (Spanish, Basque, English and French); however, the language in which the legal terms & conditions must be interpreted is Spanish.

User registration. Purchasing products requires you to register on the website by means of creating a user or “client” account. During said process, MINUSSE will ask you, having informed you on and received your acceptance of the Privacy Policy, to provide certain personal data (indicated with an asterisk*) required to manage the complete purchasing and product delivery process. Although providing said data is voluntary, it is essential if you wish to make a purchase.

The registration procedure also requires you to choose a username and password which you must use to access your account. You are responsible for safeguarding said details, preventing their use by unauthorised third parties, and for the consequences of any failure to observe this obligation.

Placing an order. The different website sections will at all times guide the Client through the online purchasing process, helping you to select your chosen articles, check their characteristics, availability, prices and delivery costs, and provisionally add them to a “basket, shopping trolley” or the like, from which they can be deleted or replaced with others at any time, prior to making payment or assuming the obligation to purchase.

  • Once you have chosen your articles, you can revise and accept, as appropriate:
    • the details of your order;
    • the delivery and/or invoicing address for your order;
    • the total cost indicated in euros (€);
    • the breakdown of the delivery costs and applicable taxes;
    • the delivery and payment method of your choice, being able in the event of an error, to correct any data provided.
  • Before finally confirming the order, you must accept these Terms & Conditions, which you can consult at any time on the website, and which you can download for consultation or save from the following link: <download link>.
  • The contract of sale will be understood to have been completed when you click on the “complete purchase” button or any other similar technical system for processing the order, which will generate a message saying: <order with obligation of payment> or the something similar.
  • MINUSSE keeps a computer record of all transactions (orders, cancellations, returns, invoices, etc.) carried out with people who make a purchase on the website. This record will be considered to represent proof of the operations carried out between the parties.
  • Purchase confirmation.Once the purchasing process has been completed, MINUSSE will send you an email indicating all of the characteristics of the order placed, the date of purchase, the total price, the method of transport, and the estimated delivery date.
  • All of the prices shown on the website are in euros (€) and include Value Added Tax (VAT). Unless otherwise indicated, the prices shown with the articles do not include the delivery costs, which will be given on adding the article to the shopping basket and completing your delivery details. Delivery costs may vary depending on where the order is to be delivered (nationally or in Europe, the Balearic Islands, the Canary Islands, Ceuta and Melilla).

The product prices can change at any time, although potential changes will not affect orders for which MINUSSE has already sent you an order confirmation.

  1. METHODS OF PAYMENT.

The methods of payment accepted on the website are as follows:

  • Payment with credit or debit card (Visa, MasterCard, Visa Electron, Maestro and Euro 6000): the data provided for credit card payment are encrypted through a safe POS (Point of Sale) system used by the bank with which MINUSSE works. In the event of paying with a credit card, you will be asked for: the card number, its expiry date and the security code coinciding with the last three figures of the number printed in italics on the back of your card.
  • Payment with a PayPal account.To use this system, you must already have a PayPal account at the moment of making payment. On choosing this system, you will be redirected to the PayPal website to complete payment; the system will show you the full amount to be paid with all taxes and costs applicable to the operation. PayPal will send a receipt of the operation to your email.

In the event that choosing any of these methods of payment entails an additional cost to the price of the article shown on the website, MINUSSE will explain the total price, giving you a breakdown of the costs applied for using your chosen means of payment prior to you acquiring the commitment to pay. In any event, this surcharge will never be higher than the real cost charged to MINUSSE for using said method.

  1. PRODUCT AVAILABILITY.

Should MINUSSE realise after an order has been normally processed that there are no such products in stock, or should a situation occur which prevents their supply, you will be immediately notified of said circumstance. In such cases, MINUSSE will proceed to reimburse the amount paid by means of the same method of payment used, without undue delay and, in any event, within 14 days from the date of purchase.

  1. DELIVERY OF PURCHASES.

Purchases can be delivered to any country in the European Union, the Spanish mainland, the Balearic Islands, the Canary Islands, Ceuta and Melilla.

Purchases will be delivered to the postal address designated by you and by your chosen method within the delivery time indicated on the website and, in any event, within 30 calendar days counting from the date of purchase.

Delivery costs may vary depending on where the order is to be delivered (nationally or in Europe, the Balearic Islands, the Canary Islands, Ceuta and Melilla).

All orders will be dispatched from Monday to Friday, except on public holidays. Orders made on weekends or public holidays will be processed on the following working day.

We always try to deliver your order as quickly as possible; however, given the delivery method (ordinary post), there may be situations or periods of the year when the delivery could be slightly delayed. If for any reason we were unable to meet the delivery date, we would inform you of the circumstance and give you the option to continue waiting for your purchase, setting a new delivery date, or to cancel your order with full refund of the amount paid.

For the purposes of these Terms & Conditions, the order will be considered to have been delivered when you or a third party authorised by you takes material possession of the products, proof of which will be the signature on the receipt of delivery of the order to the address indicated.

Delivery incidents: In the event of being unable to make the delivery due to absence of the addressee, the transport company will leave a note and will try to contact the addressee by telephone to arrange a new delivery time. In the event that the delivery were to fail a second time, after these two attempts, the package would be taken to the corresponding post office where it would remain for 15 calendar days counting from the day after the date of notification.

If, once those 15 days have passed, the package were to remain available for collection due to a reason not attributable to MINUSSE or the transport company, we would understand that you wish to terminate the contract and would consider it to have been cancelled.

On terminating the contract, we will refund all payments received from you, minus the cost of delivery, without undue delay and, in any event, within a maximum of 14 days from the date on which we consider the contract to have terminated. Where appropriate, MINUSSE can charge you for the transport costs arising from termination of the contract.

  1. INVOICING

Delivery of the articles will be considered to fall within the territory where Spanish VAT is applicable if the delivery address is in Spain, with the exception of the Canary Islands, Ceuta and Melilla. The applicable VAT will be the amount legally applicable at all times according to the specific article purchased.

In orders for the Canary Islands, Ceuta and Melilla, there will be no VAT on deliveries, although duties and/or custom taxes may apply under existing regulations.

You expressly authorise us to issue the invoice electronically. However, you can at any time indicate your desire to receive an invoice in paper format, in which we case we will issue and send you the invoice in the said format.

  1. RETURNS POLICY

Legal right to cancel the contract.

If you are purchasing as a consumer, you have the right to cancel the contract of sale within 14 calendar days with no need to provide justification. The right to cancel the contract will expire 14 calendar days after the date on which you, or a third party indicated by you, other than the transport company, acquired material possession of the goods or, when the order is composed of goods delivered separately, 14 calendar days from the date on which you or a third-party indicated by you, other than the transport company, acquired material possession of the last of the goods in question.

To exercise your right to cancel the contract you must notify MINUSSE, within the given deadline, of your decision to cancel the contract by sending an email, to pedidos@minusse.com, indicating the order number and asking for an exchange or refund. You also have the option to send any other unequivocal statement by post or email. MINUSSE will inform you immediately by means of a durable medium (email for instance) of having received said wish to cancel the contract.

Consequences of cancelling the purchase. In the event of cancelling the purchase, we will return all payments made by you, with the exception of the delivery costs, without undue delay and, in any event, no later than 14 calendar days from the date on which you inform us of your decision to cancel the contract.

We will refund the amount due through the same means of payment as used by you to make the initial transaction, once all of the goods have been returned and checked.

The order must be returned to the address indicated by MINUSSE together, where appropriate, with the invoice issued, and you will be responsible for the direct cost of returning the product. The products must be in perfect condition, not have been opened or used, and must either remain sealed or in their original packaging, with the accessories or promotional gifts included where appropriate.

You will hold the sole responsibility for any reduction in value of the goods resulting from handling other than necessary to establish their nature, characteristics and functioning.

Exceptions to the right to cancel the contract: You will not have the right to cancel the contract in the event that it involves the supply of any of the following products:

  • Personalised articles.
  • Goods sealed for health and safety purposes which have had their seals removed after delivery.

Guarantees and Returns.

For the purposes of these Terms & Conditions, returns will be understood to be the result of a defect, fault or delivery of the wrong product.

The products will be considered to meet these Terms & Conditions when they correspond to the description and qualities indicated on the website, are apt for the uses indicated, and are of a quality comparable to that of other products of the same or similar characteristics.

Returns. In the event of finding, on receiving delivery of the order, that it has a fault, defect or that the product is not the one you ordered, you must immediately inform MINUSSE of this circumstance by writing to the email pedidos@minusse.com, indicating the details of the product and the extent of its damage. We will then tell you how to proceed with its return.

Once returned, the articles will be checked by MINUSSE, after which we will tell you whether or not the product will be refunded or, where appropriate, replaced.

MINUSSE will refund the corresponding amount (including the cost of making the initial delivery) without undue delay and, in any event, within 14 calendar days from the date of receiving the returned order. Refunds will be made by the same means used to pay for the goods received.

  1. EXEMPTION AND LIMITATION OF LIABILITY.

Within a process of continuous improvement, MINUSSE continually updates all of the information and services offered on the website, always doing its utmost to avoid the existence of errors or mistakes, provided that these are due to means, services or tools over which MINUSSE has direct power of control.

MINUSSE does not guarantee the availability and continuity of the website function. When reasonably possible, MINUSSE will issue prior warning of interruptions in the website service.

Unless expressly stipulated to the contrary in these Terms & Conditions, our liability in relation to any product acquired on this website will be strictly limited to the price of purchasing said product.

  1. COMMUNICATIONS

By accepting these Conditions you give your for the Customer Services Department to send you all communications by electronic means (email).

CUSTOMER SERVICE.

For any doubts, suggestions, queries or complaints regarding the website or orders made, you can write to the Customer Services Department by any of the following means:

The Customer Services Department will give you an identification number and written justification (email) of having made a complaint. MINUSSE will deal with your request within the shortest possible time and, in any event, within a period of one month. If you feel that your request has not been satisfactorily resolved, you can take recourse to ordinary law, or submit your complaint for processing to either the Citizen’s Advice Office in your place of residence or to the Consumer Arbitration Board in your Autonomous Community.

  1. SECURITY AND CONFIDENTIALITY.

MINUSSE guarantees the security and confidentiality of its communications with you. All online payment operations are carried out through a safe server, based on the SSL standard, which protects data from infringement attempts by third parties. The data corresponding to the purchasing process will be stored in a purpose-designed database.

MINUSSE also guarantees the protection and confidentiality of the personal, payment and any other kind of data provided by you according to the stipulations of the General Data Protection Regulation.

You can, at any time, exercise your right of access, rectification or deletion of your personal data. In some cases, you may also object to us using your data or change controllers, informing us of your decision by writing to the MINUSSE postal address: Ametzagaña 25 Bajo (Galerna Studio), 20012, Donostia (Gipuzkoa).

  1. GOVERNING LAW AND JURISDICTION

Under European consumer regulations, the legislation and jurisdiction applicable to purchases made from MINUSSE.com will be those corresponding to the Client’s place of residence, when they have their place of residence and have made their purchase in any of the countries in the European Union.

In this respect, and in accordance with European Regulation no. 524/2013, MINUSSE informs you of the existence of an online European platform to enable the settling of litigations out of court for contracts also drawn up online between consumers and the providers of Internet services (Minusse.com).
